DHS to Terminate Temporary Protected Status for Afghans

The Department of Homeland Security has announced that it will terminate the deportation protections under the Temporary Protected Status (“TPS”) program for Afghanistan citizens.

The TPS program provides temporary work authorization and deportation relief to migrants whose home countries are classified as unsafe due to conditions such as war, environmental disasters, epidemics, and other extraordinary circumstances. Upon review, the DHS has determined significant improvements in Afghanistan’s security and economy and no longer qualifies for TPS.

Further noted in its announcement, the DHS has found that some Afghan recipients have been investigated for fraud and threats to national security.

The Afghan TPS designation will expire on May 20, 2025, and will not be renewed. Termination of the status will go into effect on July 12, 2025. Recipients will be protected until July 12th, and new applications will be reviewed until then.

Upon expiration of TPS, Afghan migrants will lose work authorization and be vulnerable to deportation unless they can secure another lawful status. We recommend proactively consulting a deportation defense lawyer to discuss potential paths to lawful status.
