Being denied a green card is heartbreaking and life-changing. But for one RMZD client, he refused to give up. And he was rewarded last week with his very own green card. Here is our client’s uplifting story about how he was able to benefit from a recent change in the law.
Reeves Miller Zhang & Diza is proud to share the story of Alfredo Lina, a longtime client who finally received his green card after nearly 20 years in the U.S.
Alfredo is a native and citizen of the Philippines. He entered in the U.S. in 1998 with a K-2 visa. His mother was engaged to be married to a U.S. citizen and she was permitted to come to the U.S. with a Fiancé(e) Visa (K-1) so that she could marry her fiancé. Since Alfredo was unmarried and under 21 at the time, he was permitted to enter the U.S. with his mother. Therefore, the U.S. Embassy in Manila issued him a K-2 visa.
Alfredo’s mother married her U.S. citizen petitioner after they entered the U.S. This made both Alfredo and his mother eligible to file applications for adjustment of status and receive their green cards. Alfredo’s mother received her green card many years ago and has enjoyed all of the benefits of permanent residency (employment, travel, etc.). However, due to the government’s delay in processing Alfredo’s case, his application was denied because he had already turned 21-years-old.
Alfredo was devastated! He had given up his life in the Philippines and had nothing to go back to. So he decided to stay in the U.S. and make a life for himself here, which would be difficult given his lack of valid immigration status. Alfredo was doing great, but he knew he could do even better if only he had his green card. He then decided to seek out the assistance of Reeves Miller Zhang & Diza. His case was assigned to Attorney Devin Connolly, one of the firm’s Senior Partners.
Attorney Connolly immediately told Alfredo that he had great news for him. He told Alfredo that he was now eligible for his green card based on his mother’s marriage, even though by now he was closer to 41-years-old than 21-years-old.
Attorney Connolly explained that there had been a recent change in the law that directly applied to Alfredo’s case. He said that it was not well-known by everybody, and so we would have to prepare a legal brief clearly stating how Alfredo was eligible despite his age. Attorney Connolly began working on Alfredo’s case right away, excited to help this man finally receive the green card that he deserved.
Reeves Miller Zhang & Diza is now pleased to announce that Alfredo has received his green card. It took a lot longer than he originally expected, but after all these years, he can now finally say that he is a permanent resident of the U.S. Alfredo can now legally work in the U.S., he can travel, and he no longer has to wonder if today will be the day he is forced to go back to the Philippines.
