A federal judge recently ruled in favor of the state of Florida, allowing it to enact legislation that allows the state to prosecute individuals who transport undocumented noncitizens into or within the state with the crime of human trafficking.
On May 10, 2023, Florida Governor Ron DeSantis signed Senate Bill 1718 which he described as the “strongest anti-illegal immigration legislation in the country.” In July 2023, advocacy groups including The Southern Poverty Law Center, ACLU of Florida, American Civil Liberties Union, American Immigration Council, and the Americans for Immigrant Justice filed a lawsuit to challenge the legality of most of SB 1718. They cited the likelihood of “unlawful arrest, prosecution, and harassment,” and argued that SB 1718 unconstitutionally interferes with the federal government’s power to regulate immigration.
