With the ongoing migrant surge in New York, the State, spearheaded by Attorney General Letitia James and state Education Commissioner Betty Rosa, has issued a formal warning to its districts to ensure that school-aged migrant children are permitted to enroll. Schools that make the enrollment process unreasonably difficult or block migrant children from enrolling can face lawsuits and fines.
This motion stems from recent reports of discriminatory practices targeting migrants, including requiring a voter ID from parents registering their children, proof of residency on a regular basis, and establishment of residency dated over 30 days. All these requirements may compromise the State’s promise of free public education to any individual ages 5 to 21, regardless of their status.
