STEM Employees May Become Eligible for Streamlined Green Card Petitions

Foreign-born workers in the Science, Technology, Engineering, and Math professions may become eligible for streamlined immigration processes in the near future. Over the past year, the Biden Administration has made a push to attract global talent in these industries. In October of 2023, the Biden administration released an Executive Order on Safe, Secure, and Trustworthy Artificial Intelligence, requesting the acceleration of hiring in AI and related professions.

On November 8, 2023, the U.S. Department of Labor (DOL) submitted a proposal for federal review regarding the expansion of “Schedule A.” Once approved, public comments will be solicited to determine whether STEM professions should be eligible for streamlined visa and green card processing.

When the DOL determines a shortage of labor in a specific profession, they may issue a “Schedule A” which will allow for a more efficient and timely green card process. Employers in the “Schedule A” occupations will be exempt from testing the U.S. labor market and filing a PERM application.
