Federal Judge Rules Against Family Separation

Recently U.S. District Court Judge Dana Sabraw approved the DOJ’s settlement, ruling against the Trump-era family separation policy. During Trump’s presidency, family separation at the border was enacted to deter migrants and ultimately resulted in a large number of minor children being separated from their parents.

This recent ruling will ideally prevent future enactment of the policy, especially prevalent with the upcoming 2024 election. The settlement also:

  • Provides non-monetary assistance to those impacted by the policy and the ability to receive 3 years of humanitarian parole, and expedited asylum
  • The ban of all similar policies until December 2031

Note, that the settlement enables agencies to enact family separation in extreme circumstances such as in cases of abuse or other threats to the child’s safety but disbars the mass practice of separation as a means of prosecution.
