Eric Welsh recently appeared on a TV segment for Spectrum News’ “Capital Tonight,” examining the legal battle between Texas and the federal government over a razor fence installed by the state along the U.S.-Mexico border. The segment, “Circuit court hearing arguments in Texas razor wire case,” discusses the ongoing hearing of the Fifth U.S. Circuit Court of Appeals over the validity of the Supreme Court’s January ruling allowing federal officials to cut the fence.
The state is arguing that such ruling is a violation of state property rights. However, the federal government is claiming that the fence is ultimately an interference with federal legislation, arguing that federal law supersedes state law. Eric explains, “It’s more than anything else — and this is, again, from the perspective of the federal government — a nuisance to the customs agents who have a job to do, and that job involves not just physically stopping people but also interrogating people.”
