Though many are celebrating international “Pride Month” this June, there continues to be a surge in anti-LGBTQIA+ sentiment globally. Discrimination and persecution unfortunately impact many, and the governance of these brutalities is low in a vast amount of foreign nations.
While the U.S. still faces its own struggles in acceptance of these communities, compared to other countries, the U.S. is a safe haven for many LGBTQIA+ asylum seekers due to the laws in place. A UCLA study found that 1.3 million of the current U.S. adult immigrant population identify as LGBTQ+.
For those facing unsafe conditions in their home country, seeking asylum in the U.S. may be a preferable option.
Asylum Criteria
To receive asylum, immigrants must demonstrate persecution, for their:
- Nationality
- Race
- Religion
- Political Opinion
- Membership in a Particular Social Group
Being a member of the LGBTQIA+ community can often be a reason for persecution for many asylum-seekers from countries that are less accepting. The U.S. Citizenship and Immigration Services (USCIS) describes persecution as hostile actions or practices designed to harm ostracized groups physically, mentally, or emotionally.
Individuals who faced past persecution or fear of future persecution due to their identification as a member of the LGBTQIA+ community may be able to qualify for asylum, though they will have to prove their persecution extends beyond general harassment.
Note, that the process of receiving asylum may also entail proving one’s sexual orientation and identity, which may be uncomfortable or undesirable for some asylum-seekers.
