The Third Circuit Court of Appeals recently ruled that the Department of Justice (DOJ) cannot unilaterally revoke a green card from a lawful permanent resident. The ruling called the Trump administration’s practices “antithetical” to the separation of powers as it violates Congressional authority.
This particular case, which could set a precedent for millions of permanent residents going forward, pertains to the status of longtime New Jersey resident Mohammad Qatanani, who has spent more than two decades seeking permanent residency.
What Does This Ruling Mean for Qatanani and Other Legal Residents?
The Board of Immigration Appeals (BIA)’s order, part of the DOJ’s Executive Office for Immigration Review, has been lifted, maintaining that Qatanani is a permanent resident of the United States. This ruling and its justification will likely provide a legal basis for similar situations in the future.
