On March 16th, 2026, the Boston U.S. Court of Appeals for the 1st Circuit lifted the block on the Trump Administration’s third-country removal order, clearing the way for future deportations under this avenue.
In early 2025, the Trump Administration implemented a third-country removal immigration policy, permitting the Department of Homeland Security to send migrants to a “third country,” in an effort to expedite deportations. The policy has since faced legal turmoil, with many concerned over the safety of migrants deported to an unfamiliar country other than their homeland. In April 2025, United States District Judge Brian Murphy of Massachusetts issued a preliminary injunction that sought to protect due process rights for migrants facing deportation to third countries. The ruling was later lifted by the Supreme Court, allowing for eight men to be sent to South Sudan.
Most recently, in February 2026, Judge Murphy had ruled that the administration’s policy was unlawful, thereby halting the policy once again. His ruling found the policy to be unfavorable to migrants’ right to due process due to the rapid pace of deportations. However, the March 2026 ruling has granted the Administration’s request to pause Murphy’s ruling in a 2-1 panel. While Murphy’s block has been lifted, effective immediately, the government is pursuing an appeal.
Jeffrey R. Howard, Senior U.S. Circuit Judge appointed by George W. Bush, and Seth Aframe, U.S. Circuit Judge appointed by Joe Biden, signed the brief order on Monday, March 16th. Once the court completes its expedited briefing, said to be in mid-April, it will have oral arguments.
