On July 25, 2023, U.S. District Judge Jon Tigar blocked the asylum policy implemented by the Biden administration in May of this year.
The ruling found the policy unlawful on the grounds that it imposed conditions on those seeking asylum in the U.S.
The Biden administration will now have 14 days to appeal the ruling before it takes effect.
Overview of the Asylum Policy
In alignment with the termination of the Title 42 policy, the Biden administration imposed a policy aimed to regulate the southern U.S. border. The asylum policy required migrants to first try to seek a lawful process, some of which included:
- humanitarian parole program for Venezuelans, Haitians, Nicaraguans, and Cubans
- formal scheduled arrival at the port of entry
- attempting to seek third-country asylum, even if it is denied
This rule has been in effect since May 11, 2023. During this time it faced opposition from immigration advocates who sued the administration on the grounds that it subjected migrants to extortion and violence.
