Biden to Set Asylum Restrictions at Border

The Biden administration is reportedly moving forward with a regulation to secure the asylum restrictions enacted at the U.S.-Mexico border. The goal of this regulation is to create a more permanent governance, that ideally would be difficult to challenge in the future.

On June 4, 2024, Biden signed an Executive Order “suspending entry” of non-citizens crossing the border illegally and barring them from claiming asylum. These protocols are to be deactivated when crossings drop to an average below 1,500 per day. While not official, the new regulation will ideally raise the average, making it more difficult to reopen the border. Sources claim the new baseline might be 1,500 across 28 days. Additionally, the new rule will now count unaccompanied minors who were previously excluded when determining the average,

Those opposed to the rule, including The American Civil Liberties Union, are concerned it will force migrants with legitimate asylum claims back into unsafe conditions within their own country. A lawsuit was filed on June 12, 2024.
