California Federal Judge Proposes Order to Provide Hearings for Detained Individuals

On Wednesday, February 18th, a Federal Judge proposed a 22-page order for the U.S. Department of Homeland Security that would inform detained immigrants of their right to file a lawsuit against the government, and as a result, receive a hearing or be released immediately. 

The proposed order was issued by Judge Sunshine S. Sykes, a Federal Judge for the United States District Court for the Central District of California, aimed at addressing the influx of federal district dockets nationally with immigrants contesting their detentions. As the executive branch has continuously disregarded the district courts’ orders, the district court judges have since taken a stronger approach.

Judge Sykes’s proposed order brings attention to the Trump Administration and the executive branch’s mistreatment of non-US and US citizens. She writes in her proposed order, “Beyond its terror against noncitizens, the executive branch has extended its violence on its own citizens, killing two American citizens.” Additionally, in her proposed order, she discusses the executive branch’s “unlawful” and “wanton” acts.
