On Thursday, September 11, the California Legislature passed Assembly Bill 495, known as the Family Preparedness Plan Act of 2025, and it is now headed to Governor Gavin Newsom for consideration.
The bill is designed to help immigrant parents make arrangements for their children’s care in case they are detained or deported. Supporters say the measure was revised to address concerns fueled largely by misinformation.
If signed into law, the bill would expand California’s joint guardianship process, allowing parents to designate a trusted adult who could petition the court for guardianship if the parent becomes temporarily unable to care for their child such as during immigration detention.
