The news follows a number of Republican-led states and some Democrats urging the CDC and the Biden administration to extend the policy due to various concerns with its ending, including how the U.S. will handle the influx of migrants. Despite this pressure, the policy is still expected to end on May 23, 2022.

“It remains to be seen if the judge will prevent the CDC and the Biden administration from lifting Title 42 altogether,” Eric explains. “When the CDC, which is a body of scientists, has decided it is no longer necessary and in the best interest of public health, I’m not sure how a federal judge could compel the CDC or the administration to keep the policy in place.”
