Federal Appeals Court Backs Trump Administration’s Expanded Fast-Track Deportation Policy

A federal appeals court ruled 2–1 in favor of the Trump administration, allowing it to expand expedited deportations for undocumented immigrants nationwide. The decision overturns a lower court’s ruling that had blocked the policy.

Make the Road New York sued after the Department of Homeland Security expanded expedited removal to immigrants unable to prove they had lived in the U.S. for more than two years, arguing the policy violated due process rights.

Judge Robert Wilkins, an Obama appointee, argued that immigration officers acting under this policy failed to inform detainees of their rights resulting in several wrongful deportations.

Judge Justin Walker, a Trump appointee, said the issue was whether the “written policy directive” itself was unlawful, not whether some immigration officers failed to implement it properly. He concluded the expedited removal system “operates quickly and with practical constraints” but does not deny immigrants “a meaningful opportunity to be heard.”
