Federal Judge Blocks Trump Administration’s Policy on Asylum Seekers at US-Mexico Border

US District Judge Randolph Moss recently blocked a Trump administration policy which barred migrants who cross the US-Mexico border from seeking asylum. The lawsuit – brought on by immigrant rights advocates including the American Civil Liberties Union, Las Americas Immigrant Advocacy Center, and Florence Immigrant & Refugee Rights Project – was centered around whether or not the President has the ability to override the protections guaranteed by Congress.

In his decision, Judge Moss stated that nothing in the Constitution or the Immigration and Nationality Act gives the president power to broadly deny asylum for people who crossed the US-Mexico border already, regardless of their immigration status or methods.

Could the Trump Administration Appeal this Ruling?

Judge Moss stayed his decision, meaning he temporarily postponed the enforcement of this ruling, for 14 days. The Trump administration is expected to appeal during this timeframe.

Department of Homeland Security spokesperson Tricia McLaughlin and White House deputy chief of staff Stephen Miller each issued respective statements criticizing the ruling, claiming that they expect a higher court to rule in President Trump’s favor.
