Federal Judges Push Back as Trump Administration Expands Mandatory Detention

Federal judges are increasingly pushing back against the Trump administration’s aggressive expansion of “mandatory detention” in deportation cases. More than 300 judges from across the ideological spectrum have rejected the policy as illegal or unconstitutional, ordering releases or bond hearings in over 1,600 cases. 

Many others have ruled against prolonged or due-process-free detentions, sometimes likening the administration’s repeated legal losses to a futile effort.

Despite the mounting judicial consensus, the policy remains in effect because most challenges are filed as urgent, individual cases rather than broad lawsuits capable of stopping it nationwide. 

Judges have grown more alarmed in recent rulings, citing inhumane treatment as thousands of immigrants, most not accused of crimes, are detained abruptly. Often, after complying for years with immigration check-ins or court appearances. 

Advocates argue the policy’s real aim is not legal success but to discourage immigrants by making the process so harsh that many abandon their cases.
