The Trump administration is reinstating a policy that could make it more difficult for many potential legal immigrants to obtain green cards if they use or are considered likely to use government assistance programs.
The final rule, published on Monday, allows immigration officials to consider an applicant’s use of a broader range of public benefits when evaluating green card applications. This policy reverses a 2022 Biden administration policy that excluded non-cash benefits from these determinations.
Historically, immigration officers considered only cash assistance programs, such as Temporary Assistance for Needy Families (TANF) and Supplemental Security Income (SSI), when reviewing applications. The updated policy, however, does not clearly define which public benefits may be considered. As a result, it could include essential programs such as Medicaid, food assistance, housing support, childcare subsidies, Head Start, the Children’s Health Insurance Program (CHIP), and potentially certain tax credits. The policy also allows immigration officials to consider benefits received by an applicant’s family members, including U.S. citizen children.
