Provisional Unlawful Presence Waiver Leads To A Green Card

It is true that having to request a “Provisional Unlawful Presence Waiver” (Form I-601A) is more difficult than seeking adjustment of status. However, though it may take longer and require more effort, the green cards issued by the U.S. Citizenship and Immigration are exactly the same. Jesus Caldera was just like millions of other people from countries throughout the world – he desperately wanted to come to the United States because of this country’s freedoms and opportunities.  Jesus did not have a way of lawfully immigrating to the U.S., but that did not stop him.  He came anyways and began to make a life for himself while also supporting family back home in Mexico.

After years of residing in the U.S. without valid immigration status, Jesus finally decided to do something about it.  He knew that being married to a U.S. citizen could potentially help him obtain permanent resident status (green card), but he was not sure exactly how the process worked or how likely it would be to succeed.

Jesus retained Reeves Miller Zhang & Diza to assist him and his wife.  They would now be represented by Attorney Devin Connolly, a senior partner of the firm.  Attorney Connolly explained to Jesus and his wife that he was eligible to apply for a Provisional Unlawful Presence Waiver.  Attorney Connolly stated that this process was not as fast or as easy as adjustment of status, but that Jesus was not eligible for adjustment of status because of his unlawful entry and lack of prior petitions.  Therefore, if he wanted a green card but did not want to be separated from his wife for 10 years, his only option was to request a Provisional Unlawful Presence Waiver.

Jesus and Attorney Connolly began working on proving that Jesus’ wife would suffer an extreme hardship if his waiver was not granted. Amongst the submitted documents were declarations from Jesus and his wife discussing their relationship, their childhoods together, and their deep love and commitment to each other.
