Uncertainty Continues Due To Proposed Changes To The H-1B Visa Lottery

It has been nearly two months since the Department of Homeland (DHS) issued proposed regulations regarding the H-1B visa program and the filing of H-1B Cap-subject petitions, but uncertainty continues to loom as H-1B Cap season quickly approaches.

Options If Your Visa Petition Is Terminated

Termination of an immigrant visa petition has been harming long-waiting visa applicants for years. Here is the problem: a foreign national waits years (sometimes decades) for their priority date to become current so that they may immigrate to the United States, only to find out that the visa petition filed by their family member or employer has been terminated.  In this instance, the foreign national may have to start over from the beginning, which includes potentially waiting several more years.  The good news though is that, with the right immigration attorney, a solution is available.

Abuse Does Not Take A Holiday Vacation

A common misunderstanding about domestic violence is that it spikes during the holidays.  But regardless of when abusive incidents are most common, the truth is that coercive control does not ever take a vacation.

Seeking Asylum More Than One Year After Arrival in the U.S.

An asylum applicant has the burden of proving by clear and convincing evidence that he or she filed their asylum application within one year of the applicant’s last arrival in the U.S. However, an applicant who misses the one-year deadline may still be eligible for asylum if he or she can establish the existence of either changed circumstances or extraordinary circumstances.

Family and friends gather to share their joy with one another by exchanging gifts, eating delicious food or simply being in the presence of one another. Some are lucky enough to live close to family and can celebrate the holidays together.

Trump’s Assault on Asylum and the Battle for the American Spirit

Donald Trump has made a political career on demonizing immigrants, and his actions in office have been consistent with his bombastic hardline rhetoric: killing DACA, separating families at the border under a “zero tolerance” policy, and now, issuing a Proclamation that America will ignore its international obligation (not to mention moral duty) to offer safe refuge to persons fleeing persecution.  This time, Trump may have gone too far.

Ending the Long Wait: Suing the Government When It Fails to Timely Act

One of the most difficult aspects of immigrating to the United States is the waiting process.  This process can be stressful not only to the applicant, but also to the applicant’s family. This is especially true for family-based preference petitions involving siblings of U.S. citizens, where the waiting time is more than 20 years for Filipinos.

Immigration After the Midterm Elections

The 2018 midterm elections are now over and we have a split Congress. Democrats are in the majority in the House of Representatives while Republicans still control the Senate. What does that mean for immigration laws and policies? Are we any closer to seeing comprehensive immigration reform?
