On July 7, 2026, a lawsuit was filed against the Trump administration alleging that it shared confidential information of hundreds of Iranian asylum seekers with the Iranian government. Iranian detainees stated that an Iranian Interest Section Official knew private details of their immigration cases and asylum applications.
The lawsuit was filed in the US District Court for the District of Columbia by the non-profit Public Citizen on behalf of the Iranian American Legal Defense Fund. Public Citizen claims that the exchange of confidential information began in March of 2025 when the Trump administration allegedly reached an agreement with Tehran in efforts to deport asylum seekers. The exchange of confidential information is claimed to have occurred during meetings between ICE and Iranian government officials, as well as through hand-delivered notes from the U.S. government to Iranian government officials, which contained immigration files of Iranians in immigration custody. A select few individuals are explicitly named in the lawsuit, including Secretary of State Marco Rubio, Secretary of Homeland Security Markwayne Mullin, and Director of Immigration and Customs Enforcement David Venturella, along with their respective agencies.
Many of the impacted Iranian refugees are members of the LGBTQ community or religious minorities, and/or are pro-democracy protestors, who would face great risk if they were to return to Iran. Through the lawsuit, plaintiffs are asking the court to halt the disclosure of confidential information permanently, declare the disclosures unlawful, notify the affected asylum seekers, and suspend any deportations until those notifications have been completed.
What Does this Mean for Iranian Asylum Seekers?
The Trump administration, as part of its severe deportation agenda, has executed multiple deportation flights in its second term, which have included dozens of Iranians. In January 2026, these deportations occurred as Iran was severely cracking down on individuals protesting against the Iranian government.
The lawsuit claims there will be an increase in mass deportation efforts in the coming weeks, stating, “Upon information and belief, the United States is working with the Iranian Government on another mass deportation flight to Iran in the coming weeks.” Such deportation to their homeland of Iran or a third country could lead to future persecution of these individuals and physical, emotional, or mental injury.
What Rights Do Asylum Seekers Have in the United States?
Under both United States and international law, individuals who fear persecution based on race, religion, nationality, political opinion, or membership in a particular social group can apply for asylum to avoid deportation. To qualify, applicants must demonstrate either past persecution or a present well-founded fear of future harm.
Asylum seekers hold various legal rights under the United States. Under federal law, including Code 8 CFR § 208.6, asylum applications and related records are confidential, generally prohibiting the U.S. government from sharing such information with the applicant’s home country unless written consent is given. Additionally, those who are granted asylum are legally permitted to remain in the United States indefinitely.
