On Wednesday, October 23, the 9th U.S. Circuit Court of Appeals ruled that federal border agents’ practice of turning away migrants at the U.S.-Mexico border when a cap of asylum applications is met violates federal immigration law.
The 9th Circuit stated that metering, the act of turning away migrants from seeking asylum at the border due to the U.S.’s ability to provide resources and space, violated the Immigration and Nationality Act (INA) because it prohibited migrants from seeking asylum.
