The United States federal government was expected to “shut down” on October 1, 2023, as Congress had not passed necessary funding legislation. A temporary bill has pushed that deadline back to November 17. If a longer-term funding bill is not passed by then, non-essential services and work will be halted. Federal offices and services may also face reduced hours and subsequent delays.
Impact on Immigration
Some immigration services may be impacted by the shutdown including federally funded programs such as those run by the Department of Labor. PERM, H-1B, H-1B1, H-2B, and E-3 programs will experience:
- Lack of response to inquiries
- Halted processing
- Shutdowns of web-based systems used for filing, documentation, and status checks
The E-Verify, EB-5, J-1, and non-minister religious workers programs will also face suspensions. Programs impacted by the shutdown will likely adjust deadlines accordingly. However, employees and companies may face significant disruptions in applications and receipt of needed business and employment visas and statuses.
While most visa processing is expected to resume as normal, this will vary for each individual consular post. ICE and border protection services will also not be heavily impacted.
Immigration Court Cases
Cases on the detained docket will proceed with likely delays. Non-detained docket immigration cases and new filings will be paused. Individuals should receive notification of any changes to scheduled hearings, and any other updates specific to their individual case.
