Approved Petition for an O-1 Visa

Summary

Reeves Immigration Law Group recently helped a client obtain an O-1 visa based on his extraordinary ability in the sciences. This will allow him to live and work in the United States for an extended period of time.

We are pleased to share another successful result – our client’s request for O-1 status based on his extraordinary ability in the sciences was recently approved by U.S. Citizenship and Immigration Services. This O-1 approval will allow our client to reside in the U.S. and continue to excel professionally.

To qualify for O-1 nonimmigrant status as a temporary worker of extraordinary ability, a person must demonstrate that they have extraordinary ability that has been demonstrated by sustained national or international acclaim, and that the individual is coming temporarily to the U.S. to work in the area of his or her extraordinary ability. Specifically, “Extraordinary ability in the field of science . . . means a level of expertise indicating that the person is one of the small percentage who have risen to the very top of the field of endeavor.”

The case was handled by Attorney Brittany Milliasseau, a Partner of Reeves Immigration Law Group. Attorney Milliasseau was able to successfully prove that our client, a native and citizen of China, was deserving of an O-1 visa because of the following:

  • A Bachelor’s Degree and Master’s Degree in Engineering
  • Almost 20 years of experience in the field
  • Key roles within the industry for leading companies in his field of expertise
  • Publications in respected professional and trade publications
  • Receipt of National or International Awards for his excellence, and
  • Letters of recommendation from prior colleagues and supervisors.

This approval is also important for the U.S.-based company, which can now utilize the foreign national’s talents and education to further improve the products they provide to their U.S. citizen and lawful permanent resident customers.
