On Wednesday, October 29th, 2025, the Department of Homeland Security released a new interim rule impacting the automatic extension of employment authorization documents (“EAD”). Previous to the interim rule, the Biden Administration implemented a 540-day extension period, which permitted immigrants to continue working as they applied for and renewed their employment authorization documents.
Starting October 30th, immigrants will have 180 days before their authorization documents expire to file and be approved for their renewal. There are exceptions to this rule, including extensions provided by law or Temporary Protected Status employment renewals.
The DHS states the change in this rule will allow for appropriate vetting to be undergone before extending employment authorizations to immigrants. Joseph Edlow, Director of the United States Citizenship and Immigration Services (“USCIS”) states this policy change is, “a commonsense measure to ensure appropriate vetting and screening has been completed before an alien’s employment authorization or documentation is extended.” However, immigrants with pending renewal claims have been screened at least once and sometimes more under the current extension period.
What Does This Mean for Immigrants?
Individuals who have submitted for renewals prior to October 30th will still have the 540-day extension to obtain their renewal documents; however, those who submit after October 30th will now only have up to 180 days prior to their document expiration to file for renewal. Immigrants are able to file for renewals up to 180 days before they expire, which is USCIS’s recommended timeframe in order to prevent a temporary lapse in work.
This means that immigrants will have a much shorter time frame for their employment authorization documents to be filed and approved, in addition to the worsening administrative backlogs. As a result, many immigrants may be unable to work and face potential job loss, due to the loss of legal employment authorization.
