Supreme Court Allows End of Temporary Protected Status for Venezuelans

In a recent decision, the Supreme Court ruled for a second time to allow the Trump administration to proceed with their plans to cease the implementation of Temporary Protected Status (TPS) for Venezuelans, a move that will affect an estimated 300,000 migrants living in the United States.

This decision comes after the Ninth Circuit Court of Appeals previously granted the Trump administration’s request to end TPS immigrants from Honduras, Nepal, and Nicaragua amid the administration’s broader push to crack down on immigration.

Why Did the Court Hear This Case a Second Time?

The Supreme Court originally heard this case, reaching a similar outcome, in May, which stemmed from Homeland Security Secretary Kristi Noem’s decision earlier this year to dismantle the TPS for Venezuelans initially granted by the Biden administration in 2021. However, a California district court’s ruling reinstated the emergency appeal process, which led to the Supreme Court hearing this case once more, reaching the same decision.

“Although the posture of the case has changed, the parties’ legal arguments and relative harms generally have not,” the court stated. “The same result that we reached in May is appropriate here.”

In her dissent, Justice Ketanji Brown Jackson wrote that she believes the decision to be “yet another grave misuse of our emergency docket.”
