Flomy Diza Discusses SCOTUS Birthright Ruling in Law360

Flomy Javier Diza was recently featured in Law360’s article, “Justices’ Birthright Ruling Leaves Little Room For Congress,” where he discusses the United States Supreme Court’s ruling finding President Donald Trump’s executive order limiting birthright citizenship for noncitizens to be unconstitutional. The 6-3 ruling, issued on June 30, 2026, also bars Congress from implementing the executive order through legislation.

The decision follows a lengthy legal battle over the executive order and provides needed reassurance for many immigrant families, particularly expectant mothers, by reaffirming the constitutional protections surrounding birthright citizenship. Flomy explains to Law360 that this ruling guarantees children born in the United States are granted citizenship regardless of their parents’ immigration status. He continues to emphasize the significance of this ruling, noting that it has eliminated a major source of anxiety for his clients and noncitizens across the country. “In so far as our practice is concerned, the decision provides a certainty and stability for millions of immigrant families,” he tells Law360.
