Florida Officials Target Undocumented Immigrants in New Driver’s License Ban

A new Florida law being touted by Governor Ron DeSantis as “the strongest anti-illegal immigration legislation in the country” means that the Sunshine State will no longer accept driver’s licenses issued by five other U.S. states to immigrants living in the country illegally.

The law, which took effect in Florida on July 1, says that out-of-state licenses from Connecticut, Delaware, Hawaii, Rhode Island and Vermont which were specifically intended for undocumented immigrants will now be considered invalid by the Florida Department of Highway Safety and Motor Vehicles (FDHSMV). Some of these licenses indicate “Not for Federal Identification” or “Driving Privilege Only.” Still, under the new law, those driving in Florida with these licenses will now face citations.

What Else is Contained in This Immigration Legislation [2023]?

DeSantis’ new law also:

  • prohibits anyone without immigration documentation from getting a Florida driver’s license
  • requires businesses with more than 25 employees to use E-Verify, a federal system that determines if employees can legally work in the U.S.
  • beefs up smuggling penalties along with subjecting offenders to prosecution under the Florida RICO Act
  • blocks municipalities and counties from funding individuals or organizations that issue ID documents to those without proof of lawful presence in the U.S.

This law comes as DeSantis seeks the 2024 Republican presidential nomination and is looking to secure backing from conservative voters who support tough immigration policies. DeSantis also announced a move to end birthright citizenship, a policy he proposed as part of his 2024 presidential campaign.

“Someone who is in our country illegally and has violated our laws should not possess a government-issued ID which allows them access to state-funded services and other privileges afforded to lawful residents,” he stated in the press release.

So for those asking “Can undocumented immigrants get a drivers license in Florida?” the answer is now no. FLHSMV leaders said it and the Florida Highway Patrol plan to “strictly enforce” the new law, insisting the new rule is “about safety and security.”
