New Jersey Permitted to Detain Immigrants Facing Deportation

On August 29, 2023, a federal judge ruled against New Jersey’s ban on detaining individuals facing deportation. Since 2021, privately-operated and government-operated detention centers have been prohibited under statute AB 5207.

CoreCivic, a prison company operating the last U.S. Immigration and Customs Enforcement (ICE) detention center in the state, challenged this legislation in February. The recent ruling in favor of CoreCivic states this statute unlawfully interferes with federal agencies’ ability to enforce immigration laws.

Matthew Platkin, New Jersey’s Attorney General, issued a statement expressing the state’s interest in appealing this decision. Activists remain concerned due to the facility’s history of medical neglect and substandard conditions.
