On May 22, 2025, Judge Jeffrey White of the Northern District of California sided in favor of Reeves Immigration Law Group on behalf of their student immigrant clients, granting a nationwide injunction that will prevent the arrests and incarceration of individuals nationwide and reverse wrongful termination of SEVIS records.
The W.B. v. Noem, et al. ruling is the first in the plentiful cases involving students and will set precedence for future rulings.
Ben Loveman, one of the lead attorneys on the case tells Law360 that this ruling comes as a relief to the Plaintiffs. “Until now, they’ve been worried — even though a lot of them had temporary protection or ICE claimed to be restoring their status, they didn’t know what ICE was going to do next. With this order, they have more permanent protection,” he expresses.
In another interview with ABC, Ben noted that this win comes as the Administration and federal government have begun presenting new arguments against immigrants. “Judges have sided with us and other attorneys across the country, and, that’s nice,” he says, adding “…what the government did was totally unlawful.”
While this case is monumental in the continuous fight for international student rights under the new Administration, Ben explains to Newsweek that there is still work to be done, stating “In the background, we’re also sure that the Department of Homeland Security and ICE are searching for other ways to continue on their goal, whatever their motivation is behind that, to harass students and target universities.”
“We can speculate and certainly see that it’s going to impact enrollment. It’s going to impact the desire to come and study in the United States.” Ben continues in his ABC interview, noting that we are also seeing declines in tourism due to these federal injust actions.
