Texas Judge Temporarily Blocks New Parole in Place Immigration Program Following Lawsuit

On Monday, August 26th, a federal judge in Texas ruled in favor of temporarily blocking the Parole in Place program after sixteen Republican-led states filed a lawsuit against the Biden administration and the program. District Judge J. Campbell Barker ruled that the states’ arguments “are substantial and warrant closer consideration than the court has been able to afford to date.”

While the ruling prevents the government from granting parole under the program, it does not block the government from accepting applications. Immigrants can still apply for Parole in Place, but their applications will not be processed unless the program is unblocked.

Parole in Place Program

The goal of the Parole in Place program is to unite hundreds of thousands of noncitizen spouses of U.S. citizens with their families and give them a pathway to citizenship. Over half a million people qualify for this program and as information is changing regularly, it is important to stay up to date and speak with an immigration attorney.

If you believe that you qualify for this program, it is recommended that you speak with an experienced family immigration lawyer.
