USCIS “Special Agents” with Arrest Powers Starting October 2025

On September 5, U.S. Citizenship and Immigration Services (USCIS) announced the creation of a new class of USCIS “special agents.” They will be authorized to carry firearms and make arrests for both civil and criminal violations related to immigration and non-immigration matters.

A new regulation, which formalizes a delegation of authority made in May, will go into effect on October 6, 2025. Under this rule, the USCIS Director is authorized to establish law enforcement roles with the power to:

  • Initiate investigations into any criminal or civil violation of the Immigration and Nationality Act.
  • Arrest any individual accused of violating immigration law or having committed immigration crimes, or has been observed committing a federal crime.
  • Arrest any individual accused of facilitating unlawful entry into the United States.
  • Execute and serve search and arrests warrants.
  • Carry firearms, conduct vehicular pursuits, and use force, up to and including lethal force, when appropriate.

How Will This Policy Change Affected Immigrants?

Although USCIS claims these agents will operate only “within the jurisdiction of USCIS,” the scope of that jurisdiction is not clearly defined in law. Since USCIS processes tens of millions of applications annually, its reach could potentially extend to a wide range of immigration-related matters. 

It could significantly increase fear among immigrants, especially those applying for legal status. Individuals without straightforward eligibility might be further driven into the shadows. This policy change raises serious concerns about oversight, transparency, and the potential for overreach.
