Department of Homeland Security to Crack Down on Visa Overstays in the Aftermath of Colorado Attack

The U.S. Customs and Border Protection (CBP), Immigration and Customs Enforcement (ICE), and U.S. Citizenship and Immigration Services (USCIS) recently stated that they have received orders from Secretary of Homeland Security Kristi Noem to crack down on immigrants who are overstaying their visas in the United States.

The direction arrives in the wake of last week’s attack in Boulder, Colorado, where 45-year-old Mohammed Sabry Soliman injured twelve using a flamethrower. Soliman has been charged with a federal hate crime and state charges of attempted murder, and authorities are investigating the attack as an act of terrorism.

DHS States that Attacker Overstayed his B2 Visa, Wife and Children in ICE Custody

Assistant Secretary of Homeland Security Tricia McLaughlin alleged that Soliman, who was born in Egypt, was in the United States illegally after his B2 visa expired in February of 2023. The White House posted to X that ICE has taken Soliman’s wife and five children into custody for “expedited” deportation.

To combat violent and terroristic attacks, the Administration will be effectively ramping up the review of immigration records nationwide–particularly looking into all unlawfully overstaying the terms of their visas, against whom immediate actions will be taken. While the announcement was brief, it can be assumed that all types of visas will be examined, putting those who have overstayed outlined terms at risk for removal.
