Federal Judge Blocks Trump’s Birthright Citizenship Order with Class Action Ruling

Federal Judge Joseph LaPlante recently issued a ruling that effectively paused President Trump’s birthright citizenship executive order from taking effect nationwide by certifying a class action lawsuit. The ruling includes a seven-day stay for a potential appeal.

Judge LaPlante’s ruling will likely cause the birthright citizenship issue to move back to the Supreme Court quickly, which sided with Trump last month and ruled to limit nationwide injunctions issued by federal courts in the wake of his executive order attempting to end birthright citizenship.

Does This Decision Violate the Supreme Court’s Ruling?

Although last month’s ruling barred federal judges from issuing nationwide injunctions, the Supreme Court did not touch the issue of whether judges possess the authority to accomplish the same goal using different means – in this case, a class action lawsuit. Therefore, Judge LaPlante’s decision does not appear to be at odds with the ruling.

Despite this, White House spokesperson Harrison Fields accused LaPlante of “abusing class action procedures” and added that the administration “will be fighting vigorously against” efforts of federal judges to combat Trump’s executive order.

This decision is likely to be contested and debated at the Supreme Court level once again.
