The Trump administration has continued to expand the U.S. travel ban list over the past year, prompting nearly 200 people to file a lawsuit challenging its decision to pause immigration case processing for individuals from the affected countries.
The lawsuit, filed Friday in federal court in Boston, argues that the Department of Homeland Security and U.S. Citizenship and Immigration Services lack legal authority to suspend immigration adjudications for people already living in the United States.
As a result, hundreds of thousands of immigrants have been left in legal limbo, unable to seek asylum, obtain work permits, renew student visas, process green cards, or complete citizenship ceremonies.
While the suit acknowledges the president’s authority to restrict entry into the U.S., it contends that freezing ongoing cases violates immigration and administrative law.
The plaintiffs include students, scientists, skilled workers, and family-based applicants who had already filed and paid for their applications. The lawsuit seeks to overturn the pause, which could restore processing for both the plaintiffs and others in similar situations.
