Biden Considering New Executive Action to Restrict Asylum at the Border, Sources Say

CNN recently reported that the White House is considering using executive action to restrict migrants’ ability to seek asylum in the United States if they cross the US-Mexico border illegally. This was a controversial action from the Trump era and if enacted, there will be backlash from immigration advocates. 

Every day, thousands of migrants cross the border illegally, and this has hit record levels under President Joe Biden. The consideration to enact stricter border control will be a political move before Election Day, demonstrating to the public that the White House cares about border security. 

What Executive Action Can Biden Take?

Biden, frustrated with Congress shutting down the bipartisan border bill, is considering using the authority, 212f between ports of entry to stop illegal border crossing. The 212f grants the president’s board the ability to set up immigration and border restrictions. 

The Justice Department’s Office of Legal Counsel is reviewing the proposed plans to ensure that there will be no legal challenges. In 2018, Trump attempted to use the 212f but the court ruled that this measure conflicted with asylum laws and the 212f was not able to override those laws. 

Even though no final decision regarding this executive action has been made, it is possible that the administration could examine the implications of the executive order and make no plans to move forward with it.

While migrant detentions have dropped by 50% from December to January, the U.S. Customs and Border Protection authorities continue to face challenges at the border.
